TERMS AND CONDITIONS

Policy

Our policy is to ensure that all hard-top stands and covers match their description in every way, and are supplied in fully merchantable condition. Should customers have any reason to complain about our products or services they are asked to do so directly to One Design Stands immediately the cause of their complaint is experienced.

Prices and Payment

Prices may be changed from time to time at our discretion. Packaging and carriage charges will be applied according to destination, weight and chosen delivery option. VAT is added at prevailing rates. We accept payment by credit or debit card and these will be transacted through MAW Solutions Ltd whose name will appear on the card counterfoil. Payment by cheque or postal order should be made payable to MAW Solutions Ltd and accompany the order.

Availability and Delivery

Whilst we always try to supply the item(s) requested we reserve the right to change products offered from time to time, and also at our discretion reserve the right not to supply. We recognise an obligation to supply only when we have explicitly accepted the order by email or letter post, or by taking payment for the goods requested.

All stands and covers are made to order and for this reason there will be a manufacturing lead time between ordering and despatch. This lead time can vary.

Given product availability, and when all payment has been received by us, items will be despatched by carrier or post. The customer is responsible for providing the address to which delivery can be made by our carriers between 9 am and 5 pm Mondays to Fridays inclusive, and in the event that the carrier cannot satisfactorily deliver to the address advised by the customer all additional charges to exceptionally deliver or return the goods shall be met by the customer. The customer is also responsible for the accuracy of the delivery address and we will not pay any costs arising from undelivered returns caused by errors or inaccuracies in the delivery address provided by the customer. Customers must notify us immediately when goods are not received by UK customers within 2 working days from despatch, or 7 working days from despatch to elsewhere, otherwise we cannot accept responsibility for non delivered items after this time.

 

Returns

If upon delivery any item is found to be damaged we must be notified immediately and the customer must not sign for them, or otherwise accept them in any way, as being satisfactory. We will not be responsible for items found to be damaged after having been previously accepted by the customer as satisfactory upon delivery. Damaged goods may need to be returned to us in which case they must be returned exactly as received by the customer. Damaged goods will be replaced or rectified at our expense subject to correct notification to us as described above.

Should a customer receive goods not as ordered they must be returned to us in the original box exactly as supplied and this means in an ‘as new’ condition, complete, unassembled and unused. We will reimburse all costs in full.

Should a customer receive a delivery that is correct as ordered but wishes to return goods for exchange or refund the customer must advise us of this wish within 14 days of despatch and the cost of return is at the customers expense. We will refund in full the product purchase price including vat less carriage charges and less any credit card charges providing that all goods are returned to us in the original box exactly as supplied and this means in an ‘as new’ condition, complete, unassembled and unused. Should the goods not be returned in an ‘as new’ condition we will make a deduction equivalent to their loss of market value but not less than 20% of the purchase price plus VAT, and if in our opinion their condition is such that resale is improbable we reserve the right to refuse any refund or credit.

No goods may be returned for any reason without our prior agreement. A copy of our original invoice must accompany the return.

 

Data Security and Protection

All personal information you provide to us will be held in the strictest confidence, used only for the purpose for which it was given, and not disclosed to any third party whatsoever, unless we are obliged in law to do so.

Liability

Stands and covers are warranted against faulty workmanship or materials used in their manufacture for 12 months from the date of purchase providing that the product instructions have been followed exactly, they have only been used internally within a building for the storage of hard tops of the type specified and that when moved the braked castors have been released beforehand. Covers are not washable and we will not warrant against shrinkage were they to do so in the event that they are washed.

The full extent of our liability for any loss or damage experienced by the customer is to refund the full price paid, including carriage and VAT, or replace or repair the product at no additional charge to the customer.

We will not be liable for any consequential direct or indirect loss or damage of any kind incurred by the customer, or third parties, arising from the use of our products however caused.

English law applies at all times including on sales despatched outside the UK.
